Terms & Conditions
The terms that govern our website, software, app, logo and care-plan services.
Effective date: October 1, 2026
1. Agreement
These Terms and Conditions (“Terms”) govern all services provided by eBurst Services Inc, doing business as eBurst Website (“eBurst,” “we,” “us”), to you (“Client,” “you”). By paying a deposit, signing a proposal, submitting an order, or using this website, you agree to these Terms. If a signed proposal or statement of work (“Proposal”) conflicts with these Terms, the Proposal controls for that project.
2. Services
We provide website design and development (WordPress and custom-coded), eCommerce and online shopping cart builds, one-page websites, website remodels, logo creation, software and mobile/desktop application development, SEO, website care (maintenance) plans, and related services. Published prices are starting prices; your Proposal states the final scope and price.
3. Quotes & scope
- Estimates from our online estimator are informational and are not binding offers. Pricing is confirmed in a written Proposal.
- Proposals are valid for 30 days from the date issued.
- Work not described in the Proposal is out of scope and is quoted separately before it begins.
- Stated timelines (for example, “about one month”) are estimates and depend on you providing content, feedback and approvals on time.
4. Payment terms
- Website builds: a 50% non-refundable deposit is due to reserve your project and begin work. The remaining 50% is due before the website is launched or files are delivered.
- Logo creation: paid in full before work begins.
- Software & apps: billed by milestone as set out in the Proposal.
- Care plans, SEO and other recurring services: billed in advance, monthly or annually, and renew automatically until cancelled.
- Invoices are due on receipt unless the Proposal states otherwise. Balances more than 15 days past due may incur a late fee of 1.5% per month (or the maximum allowed by law, if lower), and we may pause work, services or hosting until the account is current.
- Filing a chargeback or payment dispute for services that were delivered, instead of contacting us first, is a breach of these Terms. You remain responsible for the amount owed plus reasonable collection costs.
5. Client responsibilities
- Provide text, images, logins, product data and other materials in a timely manner, and have the legal right to use everything you provide.
- Review and approve work within 5 business days of each request. If a project is inactive for 30 days because of missing content or approvals, we may close it; restarting may require a new schedule and a restart fee.
- Ensure your website’s content, products and business practices comply with the laws that apply to you, including consumer-protection, privacy, tax and industry rules.
6. Revisions & changes
Each build includes two rounds of design revisions before development and one round of revisions before launch unless the Proposal states otherwise. Additional revisions or changes to approved work are billed at our hourly rate or quoted as a change order.
7. WordPress & custom-coded websites
- WordPress sites can be managed by you through the WordPress dashboard. We are not responsible for problems caused by changes you or third parties make to themes, plugins, code or settings.
- Custom-coded sites are billed at an additional $1,000 per build and require a web developer to make content and functional changes. Changes are covered by a care plan’s included time or billed hourly.
8. eCommerce products
- Online Shopping Cart and eCommerce Website builds include up to 50 products loaded before launch.
- Each product beyond 50 at launch is $15.
- The 50-product allowance applies to launch only. Products added after launch are billed at $15 each (or as included in a Commerce Unlimited care plan). Unused allowance does not carry over.
- You are responsible for product accuracy, pricing, taxes, shipping, returns, fulfilment and customer service for your store, and for maintaining your own payment-processor accounts.
9. Plugins, licences & third-party services
- On-page SEO is included with every build. The Yoast SEO plugin is an optional add-on for $199.
- Premium or specialty plugins, themes, fonts, stock media, and software licences that your website needs are purchased by you and remain your responsibility to renew.
- Hosting, domains, email, payment processors, and other third-party services are governed by those providers’ terms. We are not liable for their outages, pricing changes, or policy changes.
10. Care plans
- Care plans cover WordPress and WooCommerce sites and are delivered using the ManageWP platform and related tools. Custom-coded sites receive an equivalent plan quoted individually.
- Monthly plans may be cancelled with 30 days’ written notice. Annual plans are paid in advance and include two months free.
- Included edit and development time resets each month and does not roll over.
- Unlimited and Commerce Unlimited plans include unlimited requests for content edits, design adjustments, new pages, small development tasks and (Commerce Unlimited) product uploads. Requests are worked one at a time in the order you set, and each request should take about four hours or less. New builds, redesigns, new systems and major features are quoted separately. We may move an account that consistently exceeds fair use to an appropriate plan after notice.
- Backups, monitoring and security scanning reduce risk but cannot guarantee that a site will never be compromised or go down.
11. 3-Year Website Upgrade Plan
- The plan is an add-on to a website build. You make 36 consecutive monthly payments at a discounted rate. When the 36th payment is made, we design and build a new website of the same build type (and the same WordPress or custom-coded platform) at no additional cost.
- You may upgrade to a larger build by paying the difference between the published prices at that time.
- The new website is scoped like the original build type. Additional features, pages beyond the build type’s limits, and extra products follow our standard pricing.
- Payments must remain current. If the plan is cancelled or more than two payments are missed, the free-website benefit ends. Payments already made are not refundable, but they may be applied as a credit toward a new build within 12 months of cancellation.
12. Software & apps
Software and application projects are scoped in a Proposal after discovery. App-store approval (Apple App Store, Google Play, Microsoft Store) is controlled by those platforms. We will follow their published guidelines but cannot guarantee approval or approval timing. Developer-account fees are paid by you.
12a. White-label & reseller partners
Businesses approved for our White Label & Reseller Program resell our services under their own brand. They are bound by a separate partner agreement and mutual NDA, which control over these Terms where the two conflict.
- Partners are independent businesses, not agents or employees of eBurst.
- Partners set their own retail prices and are responsible for billing and supporting their own clients.
- eBurst will not solicit a partner’s clients.
- Partner pricing is confidential.
- Approval is at eBurst’s discretion and may be withdrawn for non-payment or misrepresentation.
13. Ownership
- When the project is paid in full, you own the final website design, custom code written for you, and content you supplied, subject to third-party licences.
- Until full payment, all work remains the property of eBurst.
- We keep ownership of our pre-existing tools, frameworks, libraries and know-how, and grant you a perpetual licence to use them as part of your delivered project.
14. Portfolio rights
Unless you ask us in writing not to, we may display the completed work in our portfolio and include a small “Powered by eBurst Services Inc” or similar credit in the website footer.
15. Launch warranty
For 30 days after launch, we will fix defects in work we delivered at no charge. This warranty does not cover changes made by you or third parties, third-party plugin or service updates, hosting problems, or new features. Except as stated here, services are provided “as is,” and we disclaim implied warranties to the extent permitted by law. We do not guarantee specific search rankings, traffic, sales or results.
16. Limitation of liability
To the maximum extent permitted by law, eBurst is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, revenue or data. Our total liability for any claim relating to our services is limited to the amount you paid us for the specific service giving rise to the claim during the 12 months before the claim.
17. Indemnification
You agree to defend and hold harmless eBurst from claims arising from content, products or materials you provide, your use of the website, or your violation of any law or third-party right.
18. Termination
Either party may end a project with written notice. If a project ends early, you pay for work completed up to that date. Any deposit is kept, and we deliver the completed work once the account is paid. We may suspend or end services for non-payment, abusive conduct, or unlawful use.
19. Governing law
These Terms are governed by the laws of the State of Florida. Any dispute will be resolved in the state courts located in St. Lucie County, Florida. Before filing any claim, both parties agree to try to resolve the dispute informally for at least 30 days after written notice.
20. General
These Terms, together with any Proposal, are the entire agreement between us for the services. If any provision is unenforceable, the rest remains in effect. We may update these Terms by posting a new version on this page; the version in effect when you sign a Proposal applies to that project. Our Refund Policy and Privacy Policy are part of these Terms.
